Regulation on sports and recreational activities and events

(pursuant to art. 28 of M.D. 100 of 28.04.2017)

1. Sports and recreational activities and events are not permitted in Zones A and B.
2. In Zone C, the carrying out, in organised or spontaneous form, of sports and recreational activities and events carried out with motor-powered means of any type is not permitted, in order to ensure the safeguarding and integrity of marine and coastal habitats.
3. In Zone C, the carrying out, in organised or spontaneous/individual form, of sports and recreational activities and events relating to the following disciplines is permitted, subject to authorisation by the managing body, and in compliance with the ordinances of the competent Port Authority:
   1. Kitesurfing;
   2. Surfing and Paddle Surfing;
   3. Windsurfing;
   4. Sailing;
   5. Swimming;
   6. Canoeing;
   7. Kites;
   8. Beach volleyball.
4. During the carrying out of the activities referred to in paragraph 3, the improper use of voice diffusion systems and acoustic or sound signals is not permitted.
5. For the purpose of issuing the authorisation, with a maximum annual validity, referred to in paragraph 3, applicants must:
   1. distinguish between spontaneous/individual activities and organised activities;
   2. be authorised according to current regulations on the matter;
   3. indicate the characteristics of the means, equipment  and materials used for the activity;
   4. provide a specific report on the methods of carrying out and on the subject of the activities;
   5. submit the documentation relating to the possession of the requirements provided for recreational craft, referred to in art. 18 of the present Regulation, in the case of using support nautical craft;
   6. pay the managing body a fee as a secretarial charge, according to the methods indicated in the following article 35;
   7. provide a formal declaration of acknowledgement of the updating decree, of the regulation, of the present regulation and of any annual provisional regulations.
6. The issue of the authorisation entails the obligation to provide the managing body with information relating to the activities carried out, for the purposes of monitoring the marine protected area, as well as to carry out specific awareness-raising and information activities for participants, inviting them to respect the environment in use and to provide them with the specific information material prepared by the managing body.
7. In order to preserve the natural environment from damage and not to cause disturbance to the fauna, the managing body, at the time of issuing the authorisation, may establish prescriptions relating to the areas, routes, means and methods of carrying out the activities.
8. In relation to the environmental protection needs underlying the founding decree, the managing body reserves the right, following the monitoring carried out, to adapt, by subsequent measures, after consulting the Reserve Commission, and with prior approval by the Ministry, the sports and recreational activities and events.
9. The nautical craft supporting sports and recreational activities and events must comply with the provisions of articles 18, 19, 20, respectively on recreational navigation, mooring and anchoring.
