Regulation on mooring activity

(pursuant to art. 19 of M.D. 100 of 28.04.2017)
  1. Mooring is not permitted in Zones A.
  2. In Zones B, mooring of small boats and recreational vessels is permitted, subject to authorisation by the managing body, at sites suitably identified and equipped by the managing body.
  3. In Zone C, mooring of small boats, recreational vessels and ships is permitted, subject to authorisation by the managing body, at sites suitably identified and equipped by the managing body.
  4. In Zone C, compatibly with the needs of protecting the marine environment, mooring of nautical craft authorised by the managing body, used for small-scale artisanal fishing, fishing tourism, passenger transport and guided tours, is permitted exclusively at the individual buoys set up for this purpose.
  5. Within the water areas used for mooring fields:
    1. bathing and underwater activities with or without self-contained breathing apparatus and free diving are not permitted;
    2. anchoring, free navigation and the presence of unmoored nautical craft are not permitted;
    3. sport and recreational fishing, and professional fishing and small-scale artisanal fishing are not permitted;
    4. the mooring of recreational craft to buoys reserved for specific activities is not permitted;
    5. mooring must be carried out exclusively  at the buoy identified by the managing body;
    6. for each buoy only one nautical craft may be moored;
    7. any activity that causes disturbance or obstruction to the proper functioning of the mooring field is prohibited.
  6. By measure of the managing body, with prior approval by the Ministry, in Zones B and C further water areas may be identified to be equipped with mooring buoys for recreational craft only, reserved for temporary stopover only, also for the purposes of bathing, positioned compatibly with the needs of protecting the marine environment, suitably equipped and marked. Bathing is permitted in the aforesaid areas according to the methods provided for by the Bathing Safety Ordinance.
  7. For the purpose of mooring, interested parties must request the managing body to issue the authorisation, with a maximum annual validity, against payment of a fee as a secretarial charge according to the methods referred to in the following art. 35, commensurate with:
    1. the overall length of the recreational craft/nautical craft;
    2. the duration of the stopover.
  8. For the purpose of issuing mooring authorisations, owners of small boats, vessels and recreational ships certifying the possession of additional environmental eco-compatibility requirements, in addition to those provided for in the preceding art. 18, paragraphs 4 and 5, identified by the managing body by subsequent measure, with prior approval by the Ministry, enjoy preferential title and may pay the relevant fees at a reduced amount.
  9. In relation to environmental protection needs, the managing body reserves the right, following the monitoring carried out, to adapt by subsequent measures, after consulting the Reserve Commission, and with prior approval by the Ministry, the regulation of the mooring activity.
  10. Nautical craft must comply with the provisions for recreational navigation referred to in the preceding art. 18.

Zone B With authorisation Nelle zone B è consentito, previa autorizzazione del soggetto gestore, l’ormeggio ai natanti e alle imbarcazioni da diporto, nei siti opportunamente individuati e attrezzati dal soggetto gestore. Con provvedimento del soggetto gestore, previa approvazione del Ministero, possono essere individuati nelle zone B e C ulteriori specchi acquei da attrezzare con boe di stazionamento per le sole unità da diporto, riservate alla sola sosta temporanea, anche ai fini della balneazione, posizionati compatibilmente con le esigenze di tutela dell’ambiente marino, opportunamente attrezzati e segnalati. Nelle predette aree è consentita la balneazione secondo le modalità previste dall’Ordinanza di Sicurezza Balneare.
Zone C With authorisation Nella zona C è consentito l’ormeggio ai natanti, alle imbarcazioni e navi da diporto, previa autorizzazione del soggetto gestore, nei siti opportunamente individuati e attrezzati dal soggetto gestore. Nella zona C è consentito, compatibilmente con le esigenze di tutela dell’ambiente marino, l’ormeggio delle unità nautiche autorizzate dal soggetto gestore, impiegate per le attività di piccola pesca artigianale, pescaturismo, trasporto passeggeri e visite guidate, esclusivamente ai gavitelli singoli predisposti allo scopo. Con provvedimento del soggetto gestore, previa approvazione del Ministero, possono essere individuati nelle zone B e C ulteriori specchi acquei da attrezzare con boe di stazionamento per le sole unità da diporto, riservate alla sola sosta temporanea, anche ai fini della balneazione, posizionati compatibilmente con le esigenze di tutela dell’ambiente marino, opportunamente attrezzati e segnalati. Nelle predette aree è consentita la balneazione secondo le modalità previste dall’Ordinanza di Sicurezza Balneare.
