Regulation on recreational navigation

(pursuant to art. 18 of M.D. 100 of 28.04.2017)
  1. In the marine protected area the use of jet skis (without prejudice to the provisions of the bathing safety ordinance in force of the Oristano Port Authority) or water scooters and similar vehicles, the practice of water skiing and similar water sports are not permitted.
  2. Navigation is not permitted in Zones A.
  3. Navigation by recreational ships is not permitted in Zones B.
  4. In Zones B, navigation is permitted, in compliance with the provisions of the ordinances of the Port Authority, and in any case at a speed not exceeding 5 knots, within a distance of 300 metres from the coast, and at a speed not exceeding 10 knots, and within the sea strip between 300 metres and 600 metres from the coast, always in displacement trim, for the following craft:
    1. sailing, rowing, pedal or electric-powered craft;
    2. small boats;
    3. boats certifying the possession of the following eco-compatibility requirements:
      1. documentation certifying the presence of a bilge water collection system;
      2. documentation certifying the presence of tanks for the collection of sewage, for those craft equipped with toilets and galley on board;
      3. compliance of the engine with Directive 2003/44/EC regarding gaseous and acoustic emissions.
  5. In Zone C navigation is permitted, in addition to what has already been expressed in the previous paragraph 4, and according to the same methods, also to recreational ships in line with:
    1. the provisions set out in Annex IV of MARPOL 73/78, (“Rules for the prevention of pollution from sewage discharged into the sea by ships [sewage]”), as provided for by resolution MEPC 157(55) of 13/10/2006, and regulated by the “plan for the collection and management of waste produced by ships and cargo residues 2014 – 2017” and subsequent revisions and updates, drawn up by the Oristano Port Authority;
    2. the provisions set out in Annex VI of MARPOL 73/78, (“Regulations on polluting gaseous emissions produced on board ships, in particular nitrogen oxides and sulphur oxides”), as provided for by resolutions MEPC 176(58) of 10/10/2008 and MEPC 177(58) of 10/10/2008, and subsequent revisions and updates.
  6. In relation to environmental protection needs, the managing body reserves the right, following the monitoring carried out, to adapt by subsequent measures, after consulting the Reserve Commission, and with prior approval by the Ministry, the regulation on recreational navigation.
  7. The discharge at sea of untreated water from bilges or other systems of the recreational craft and of any toxic or polluting substance, as well as the release of solid or liquid waste, is not permitted; the delivery in port and the management of waste produced is permitted according to the “plan for the collection and management of waste produced by ships and cargo residues” in force, drawn up by the Oristano Port Authority.
  8. The improper use of voice diffusion systems and acoustic or sound signals is not permitted.

Zone A Forbidden Nelle zone A non è consentita la navigazione.
Zone B Forbidden Nelle zone B non è consentita la navigazione alle navi da diporto. Nelle zone B è consentita la navigazione, nel rispetto delle disposizioni delle ordinanze della Capitaneria di porto, e comunque con velocità non superiore a 5 nodi, entro la distanza di 300 metri dalla costa, e a velocità non superiore a 10 nodi, ed entro la fascia di mare compresa tra i 300 metri e i 600 metri dalla costa, sempre in assetto dislocante alle seguenti unità: a vela, a remi, a pedali o con propulsori elettrici;
Zone C Regulated Nella zona C è consentita la navigazione, oltre a quanto già espresso al precedente comma 4, e secondo le stesse modalità, anche alle navi da diporto in linea con: le disposizioni presenti nell’Annesso IV della MARPOL 73/78, («Norme per la prevenzione dell’inquinamento da liquami scaricati in mare dalle navi [seaWage]»), come previsto dalla risoluzione MEPC 157(55) del 13/10/2006, e regolamentata dal «piano di raccolta e di gestione dei rifiuti prodotti dalle navi e dei residui del carico 2014 – 2017» e successive revisioni e aggiornamenti, redatto dalla Capitaneria di porto di Oristano;
